Duties
- To hear/decide applications for expansion of nonconforming uses in accordance with provisions of Section 3.4.3.5, application for Special Permits in accordance with Section 7.2, and Special Permits for development of flood plain zones as specified in the Charlton Zoning Bylaw, Section 6.4.
- To hear/decide on petitions for variances in accordance with Massachusetts General Law Chapter 40A
Special Permits
This board has the authority to issue Special Permits for altering the number of mobile homes in an existing park as specified in Section 5.2.3 of the Charlton Zoning Bylaws.
They may grant Special Permits if the applicant can show a condition unique to the particular case, but not generally true for similar permitted uses on other sites in the same zoning district.
The Zoning Board of Appeals shall deny a Special Permit when in its judgment, a nuisance, hazard or congestion will be created, or for some other reason there will be substantial harm to the neighborhood. Derogation from general purposes, the intent of the Zoning Bylaw, or the stated district objective applicable use criteria, will not be satisfied.
